Explanatory notes:

(29) Medical practitioner. Applies to an individual included or seeing inclusion in any list prepared for the purposes of Part 2 of the National Health Service Act 1977 (c49) of medical practitioners undertaking to provide medical services. (Section 115 (6C) Police Act 1997). Also applies to those included or seeking inclusion in any list prepared by a Health Authority under section 28DA of the National Health Service Act 1977 or section 8ZA of the National Health Service (Primary Care) Act 1997 (list of persons who may perform personal medical services or personal dental services.)(Section 115 (6E)(a) Police Act 1997). Also applies to those included or seeking inclusion in any list prepared by a Health Authority under section 43D of the National Health Service Act 1977 (Section 115(6E)(b) Police Act 1997).
(30) Applies to an individual included or seeking inclusion in any list prepared for the purposes of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide general dental services (Section 115 (6C Police Act 1997). (31) Applies to an individual included or seeking inclusion in any list prepared for the purpose of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide general ophthalmic services (Section 115(6c) Police Act 1997). Also applies to those included or seeking inclusion in any list prepared by a Health Authority under section 43D of the National Health Service Act 1977 (Section 115(6E)(b) Police Act 1997).
(32) Applies to an individual included or seeking inclusion in any list prepared for the purposes of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide pharmaceutical services. (Section 115 (6C) Police Act 1997). Also applies to those included or seeking inclusion in any list corresponding to a list above prepared by a Health Authority under section 28DA of the National Health Service Act 1977 or section 8ZA of the National Health Service (Primary Care) Act 1997 by virtue of regulations made under section 41 of the Health and Social Care Act 2001 (which provides for the application of enactment's in relation to local pharmaceutical services.) (33) A director of a body corporate included or seeking inclusion in a list prepared for the purpose of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide general dental services or general ophthalmic services (Section 115 (6D)(a) Police Act 1997).
(34) A member of a limited liability partnership included or seeking inclusion in a list prepared for the purpose of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide general ophthalmic services (Section 115 (6D)(a) Police Act 1997).

(35) A member of the body or persons controlling a body corporate (whether or not a limited liability partnership) included or seeing inclusion in a list prepared for the purpose of Part 2 of the National Health Service Act 1977 (c49) of persons undertaking to provide pharmaceutical services.
(36) "Judicial appointment" means an appointment to any office by virtue of which the holder has power (whether alone or with others) under any enactment or rule of law to determine any question affecting the rights, privileges, obligations or liabilities of any person. (Section 116 (2)(a) Police Act 1997).
(37) Positions requiring a certificate for the purposes of sections 19 or 27(1) or (5) of the Gaming Act 1968. (Section 115 (5)(a) Police Act (1997).
(38) Positions requiring a certificate of consent, or a licence for any purpose of Schedule 2 to the Gaming Act 1968 (Section 115 (5)(b) Police Act 1997). Bookmakers' permits, betting agency permits, betting office licences, owners/managers of bingo clubs.
(39) Positions requiring a licence from the Gaming Board of Great Britain. Casino manager/owners, cashiers, security guards, croupiers.
(40) Positions requiring registration in accordance with Schedule 1A, 2 or 2A to the Lotteries and Amusements Act 1976 (Section 115 (5)(c) Police Act 1997).
(41) Positions requiring a licence under sections 5 or 6 of the National Lottery Act 1993 (Section 115 (5)(d) Police Act 1997).

(42) Licenses granted under section 8 of the Private Security Industry Act 2001. The SIA will be responsible for licensing those employed in a number of private security industry sectors (Section 115 (5)(ga) Police Act 1997). However, SIA has decided to seek only Standard Disclosures for door supervisors.
(43) A vulnerable adult for the purposes of an Enhance Disclosure is a person aged 18 or over who receives services of a type listed a A) below and in consequence of a type list a B) below, has a disability of a type listed at C) below.

A) The services are:
a) accommodation and nursing or personal care in a care home,
b) personal care or support to live independently in his or her own home,
c) any services provided by an independent hospital, independent clinic, independent medical agency or National Health Service body,
d) social care services,
e) any services provided in an establishment catering for persons with learning difficulties.,

B) The conditions are:
a) a learning or physical disability,
b) a physical or mental illness, chronic or otherwise, including an addiction to alcohol or drugs, or
c) a reduction in physical or mental capacity.

C) The disabilities are:
a) a dependency upon others in the performance of, or a requirement for, assistance in the performance of basic physical functions,
b) severe impairment in the ability to communicate with others, or
c) impairment a a person's ability to protect him or herself from assault, abuse or neglect. ((The Police Act 1997 (Enhanced Criminal Record Certificates)(Protection of Vulnerable Adults) regulations 2002.

(44) Any position requiring registration under Section 71 of the Children Act 1989 or registration for child minding or providing dare care under Part XA of that Act or registration under Article 18 of the Children (Northern Ireland) Order 1995 (childminding and day care.) Includes those living at premises where childminding or day care takes place or who regularly works on the premises at a time when the childminding takes place. "Childminding" has the meaning within section 79A of the Children Act 1989. " Day care" means day care for which registration is required by section 79D(5) of the Children Act 1989. Section 115 (5)(e) Police Act 1997).
(45) Includes other adults residing in the same household. (Sections 115 (5)(f) and (g) Police Act 1997).
(46) Does not include other members of the household. Those aged over 18 are entitled to a Standard Disclosure (Section 115 (5)(h) Police Act 1997).
(47) From 1st April 2003, social workers and social care workers, including those in training, are to be registered by the General Social Care Council (in England) and the Care Council for Wales (Part IV of the Care Standards Act 2000). (Section 115 (5)(eb) Police Act 1997).

(48) Any position requiring registration with the National Care Standards Commission under Part II of the Care Standards Act 2000 (establishments and agencies). These include children's homes, independent hospitals, care homes, residential family centres, domiciliary care agencies, fostering agencies, nurses agencies, voluntary adoption agencies. (Section 115 (5)(ea) Police Act 1997). In Scotland parallel provisions relate to positions requiring registration under the Regulation of Care (Scotland) Act 2001 (ASP 8) of a care service (as defined in section 2(1) of that Act). (Section 15 (5)(ee) Police Act 1997). In summary, a "care service" in the context of the Regulation of Care (Scotland) Act 2001 is either : a support service; a care home service; a school care accommodation service; and independent health care service; a nurse agency; a child care agency; a secure accommodation service; an offender accommodation service; an adoption service; a fostering service; an adult placement service; child minding; day care of children; and a housing support service. Also any position requiring registration under Part 3 of the Regulation of Care (Scotland) Act 2001 of a social worker. (Section 115 (5)(ef) Police Act 1997).
